Open Bid Report: Terms of Service
Effective date: October 19, 2026
1. Who we are. Open Bid Report (the "Service") is an Alabama-based business ("we," "us"). Contact: [email protected]. A postal address is available on request at that email.
2. Agreeing to these Terms. By subscribing to or using the Service, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the Service.
3. What the Service is. Open Bid Report is an email newsletter that summarizes publicly posted bid opportunities gathered from public sources, such as SAM.gov and state, DOT and agency bid portals, and links to the official notice. It is for information only. It is not legal, procurement, bidding, engineering, accounting or business advice, and it is not a recommendation to bid or not to bid on anything.
4. Not affiliated with any government agency. The Service is unofficial and independent. We are not affiliated with, endorsed by, or acting for SAM.gov, the U.S. General Services Administration (GSA), any federal, state or local agency, any state department of transportation, or any port, utility, transit or university authority. Agency names and notice numbers appear only to identify public opportunities.
5. Verify everything at the source. Bid information changes often. You must confirm every detail at the official notice, including due dates and times, set-asides, eligibility, prequalification, bonding, scope and the latest amendment, before relying on it. If anything in the Service conflicts with the official notice, the official notice controls.
6. No guarantees. The Service is provided "as is" and "as available." We don't guarantee that it is accurate, complete, timely or uninterrupted, or that it includes every opportunity in your industries or states. We do not guarantee any bid outcome, contract award, win rate, revenue or income. Results vary, and many bids are not won.
7. Links to other sites. We link to government and third-party websites we don't control, and we aren't responsible for their content, availability, terms or privacy practices.
8. Your selections. You're responsible for keeping your email address and your industry and state selections accurate. Your selections decide what you receive.
9. Plans, billing, renewal, cancellation and refunds.
- Plans: Free (the top 5 notices in the first industry and the first region you pick); Pro (every industry and region you select) at $19/month, $190/year, or $149/year founding-member price while offered; All-Access (all industries, nationwide) at $39/month or $390/year. Prices are in U.S. dollars and exclude applicable sales tax, which will be added at checkout where required.
- Payments are handled through our email platform, Kit, and its payment processor, Stripe. We never receive or store your full card number. Stripe's terms and privacy policy also apply.
- Automatic renewal: Paid plans renew automatically at the then-current price until canceled. We email a reminder before an annual renewal. You can cancel anytime from the link in your receipt emails or by emailing [email protected], and cancellation takes effect at the end of the current term.
- Price changes: we'll give at least 30 days' notice before a price change applies to your next renewal. Founding-member pricing stays locked while your founding subscription stays continuously active.
- Cancellation: You can cancel anytime from the link in your account or receipt emails, or by emailing [email protected]. Canceling stops future renewals, and you keep access until the end of your current paid term.
- Refunds: A full refund if requested within 7 days of the first payment. Otherwise, no refunds for partial terms except where the law requires one.
10. Acceptable use. You may use the Service for your own business's internal bid research, and you may share an individual bid link with a colleague. You may not:
- resell, sublicense, republish, redistribute or bulk-forward issues, archives or data, or share paid content outside your organization;
- scrape, crawl or systematically download the Service;
- use the Service to send spam or break any law;
- misrepresent any affiliation with us or with any agency.
We may suspend or end access for violations.
11. Our content. Government notices are public records. Our selection, organization, tagging, summaries and formatting are our work and are protected to the extent the law allows.
12. Limitation of liability. To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost bids or lost opportunities. Our total liability for any claim is limited to what you paid us in the 12 months before the claim, or $100 if you paid nothing.
13. Indemnity. You agree to indemnify us against claims arising from your misuse of the Service or your violation of these Terms.
14. Changes. We may update these Terms. We'll email or post material changes at least 14 days before they take effect. Continuing to use the Service after that means you accept them.
15. Governing law. These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law rules. Venue: the state and federal courts located in Alabama.
16. Contact. [email protected]. A postal address is available on request at that email.
